There is a strong possibility that the PDP Bill may be enacted as the Data Protection Act ('the proposed legislation), with the JCP recommending certain changes in specific provisions.

Joint Committee on Data Protection Bill Gets Sixth Extension

The Joint Committee of Parliament examining the Personal Data Protection Bill was on Wednesday given an extension till the last week of the ongoing Winter session to submit its report. The Bill, seeking to provide for the protection of personal data of individuals and establish a Data Protection Authority for the same, was brought in Parliament in 2019 and was referred to the Joint Committee for further scrutiny on the demand of opposition members.

Germany's Telecom Privacy Law Takes Effect

Hamburg's Commissioner for Data Protection and Freedom of Information announced Germany's Federal Act on the Regulation of Data Protection and Privacy in Telecommunications and Telemedia took force Dec. 1. The HmbBfDI said the law pairs with the EU General Data Protection Regulation and covers "undesired access to information stored on computers, tablets or mobile phones"

ICO Issues Provisional View to Fine Clearview AI Inc Over £17 Million

The U.K. Information Commissioner's Office announced intent to fine Clearview AI 17 million GBP for alleged misuse of scraped images and data, along with its use of facial recognition technology. Following a joint investigation with the Office of the Australian Information Commissioner, the ICO found several violations of the U.K. Data Protection Act in relation to Clearview's data processing, transparency, and consent practices.

EDPB Adopts Guidelines on International Transfers of Personal Data

During its plenary session, the EDPB adopted Guidelines on the interplay between Art. 3 and Chapter V GDPR. By clarifying the interplay between the territorial scope of the GDPR (Art. 3) and the provisions on international transfers in Chapter V, the Guidelines aim to assist controllers and processors in the EU in identifying whether a processing operation constitutes an international transfer, and to provide a common understanding of the concept of international transfers.
